TRUSTEE MEETING INFORMATION

If you are in a chapter 7: only the 341 hearing information will appear.
If you are in a chapter 13: both the 341 hearing and the confirmation hearing will appear. You will only need to attend the 341 hearing (the earlier of the two dates). Do not attend the confirmation hearing unless advised to go by our office. Your first trustee payment will be due on or before the 341 hearing. You may bring the first payment to the hearing: money order or cashier's check ONLY - no cash or personal checks will be accepted.
What you will need at your hearing (chapter 7 and 13):
1) Picture ID (driver's license or state ID)
2) Proof of your social security number (originals only). Acceptable proof: social security card, original W-2 or 1099 (make sure the FULL SSN is on the form), medicare card or social security award letter.
3) Have the 2nd credit counseling completed BEFORE the hearing date (see below tabs for link to credit counseling).
Chapter 7 only: If you have not provided bank statements covering the date you FILED (not the date of your hearing), you must have these bank statements to our office NO LATER than two weeks BEFORE the hearing.
Dress Code: Casual but conservative; jeans are acceptable. Do not wear shorts, belly shirts, micro-mini dresses, excessive jewelry or other extreme clothing. You may be asked to remove your hat if you are wearing one.
Metal detector: You will have to go through a metal detector before entering the building. Do not bring pocket knives or other sharp objects as you cannot enter the building with these items.
Parking: There is limited street parking around the hearing area. Street parking is NOT free. Parking meters accept quarters dimes and nickels and most will accept debit or credit cards. Make sure you have enough change to cover up to two hours ($1.25 per hour). There are parking lots within two blocks of the hearings but they can be expensive (minimum $10.00). The average time to conclude a docket is 45 minutes. However, you may be there as little as 15 minutes or as long as two hours. You can leave the hearings to add quarters to your meter if necessary.
Other trustee meeting issues: Do not bring children with you as you will be asked to leave if they become disruptive. Cell phones are allowed if kept on silent. Please try to have your phone available in case we need to reach you. The attorney will have a limited time to spend with you at the hearing. If you have questions NOT relating to the trustee hearing, please email the attorney in advance or schedule an appointment to discuss the matters more thoroughly.
CREDIT COUNSELING REQUIREMENTS
Course 1 needs to be completed before you file the bankruptcy. The certificate generated at the end of the course will be emailed to our office. The certificate expires after 180 days.
Course 2 is started ONLY after you have a case number. The course should be completed before you attend your trustee's meeting. The certificate will be sent to our office when you complete the course.
CHAPTER 13 INFORMATION
If you are in a chapter 13, you can click the above link to register your case. You can check on payments, claims filed and how the trustee has distributed funds. You may have to wait up to 30 days from the filing date to register.
Payments to the chapter 13 trustee can be made through a bank draft. to explore this option, click the above TFS button. You will set up the bank draft yourself and can control the frequency of the deduction.
Other acceptable payment methods are wage orders (payroll deduction - contact out office to arrange the deduction) or money orders/certified checks mailed directly to the trustee

Tax refunds and other additional payments REQUIRED to be made to the trustee
Every year that you are in a chapter 13 you MUST send the trustee your tax refund. The address to mail the tax refunds is the same as the direct payment address above. In most cases you are entitled to keep any portion of the refund that is Earned Income Credit ("EIC"). You should attempt to get a paper check from the IRS or state and mail that refund WITH YOUR NAME AND CASE NUMBER clearly written on the front along with a copy of the tax return to evidence that the payment you are sending is a tax refund. Additionally, if you are getting any other payments other than your normal source of income (i.e. lawsuit settlements, inheritances, etc.) you MUST turn those additional payments over to the trustee. You may petition the court to use those additional funds but it is ultimately up to the judge to determine whether you may keep those fund.
